Foreign importers need CTPAT validation or a validated broker

From January 5, 2027, foreign importers of record must be CTPAT-validated themselves or appoint a validated licensed broker; CTPAT is CBP’s supply-chain security program. The rule covers formal entries and informal entries requiring Forms 3461/7501 or their electronic equivalents, rather than banning all foreign informal entries. New filing fields and validation checks begin on the same date, with noncompliant filings subject to rejection.

Our read

Apparel sellers acting as importers should verify their broker’s validated status: a license or pending application alone is insufficient. US incorporation or a mailing address does not automatically establish US importer status. Prepare entity records and appointments, then confirm January clearance arrangements and pricing.

January 5 is both the effective date and comment deadline. Brokers may request delayed compliance with US-importer verification, subject to approval and full compliance by May 6. This does not generally defer the CTPAT requirement for foreign importers.

Who is affected

  • Foreign entities importing apparel or replenishing US warehouses, including covered low-value informal entries.
  • Sellers appointing a broker as importer of record must still establish the principal’s status; naming the broker does not bypass foreign-principal requirements.
  • An entity claiming US status must be organized and located in the US and meet the beneficial-owner citizenship/residency and control test or the significant unencumbered US real-property ownership test. Incorporation or an address alone is insufficient.
  • Qualifying US importers need status declarations and verification but are not universally required to join CTPAT. Domestic deliveries do not themselves create new import filings.

What to do

  • Identify the importer and broker for each route, obtain evidence of validated CTPAT status and confirm coverage for filings from January 5, 2027.
  • Have the broker assess status under 19 CFR 110.2 using ownership, control, operations and asset records. Where the broker acts as importer, check the power of attorney and required Form 5106 registration.
  • Check the new US-importer flag, acting-on-behalf flag and principal identifier with the filer, including a process for correcting missing data or rejected filings.
  • If the broker requests a delay, verify its approval, scope and end date. Verification relief does not postpone the foreign-importer CTPAT arrangements.
